Title VI overview
“Educational institutions may be liable under Title VI when they treat students differently because of their race or national origin (known as a disparate treatment claim) and when they fail to respond appropriately to racial or ethnic harassment that is so severe, pervasive, and objectively offensive that it deprives students of access to educational benefits or opportunities (known as a hostile educational environment claim). Not all racially or ethnically offensive conduct rises to the level of actionable harassment. Furthermore, to be liable for harassment, a school must have exhibited deliberate indifference—that is, its response must be clearly unreasonable in light of the known circumstances.“
